This petition is filed under Section 29A of the Arbitration and Conciliation Act, 1996 for extension of the mandate of the arbitrator. 2.

Admittedly, the amount involved is less than two crores. The original jurisdiction of this court is in matters involving two crores or more. The petitioner approached the commercial court, Patiala House Courts, New Delhi with a prayer for extension of the mandate but the application was rejected on 28.11.2025, holding that the power under Section 29A vests only with the court appointing the arbitrator.

In view of the decision of the Supreme Court in Jagdeep Chowgule v. Sheela Chowgule & Ors. decided on 29.01.2026 INSC 92, the power to extend mandate shall lie with the court having original jurisdiction i.e. commercial court, Patiala House Courts, New Delhi in this case. relevant portion of the judgment is reproduced below: "27. In view of the above, we allow the appeals, set aside the reference of the Division Bench in Writ Petition No. 88 of 2024 dated 07.08.2024 and the subsequent judgment and order of the Single Judge of the High Court in Writ Petition No. 88 of 2024 dated 21.08.2024 and restore the judgment of the Commercial Court in Civil Miscellaneous Application No. 20/2023/A dated 02.01.2024. Parties are at liberty to move the Commercial Court for further extension under Section 29A(4). The Court shall consider the application, hear the parties and pass appropriate orders." 4.

In view of the above, the order dated 28.11.2025 is set aside. The petitioner shall be at liberty to file an application before the commercial court under Section 29A for extension of the mandate. AVNEESH JHINGAN, J FEBRUARY 16, 2026 'JK'
