This is a petition under Article 227 of the Constitution of India, challenging the order dated 23.12.2024 in Civil Suit (COMM) 530/2023 titled as " Ms. Jasvinder Kaur Walia Versus Rakesh Verma" whereby the learned District Judge while allowing the application of the petitioner under Section 141and 151 CPC for filing correct affidavit of admission/denial of the documents, imposed cost of Rs.40,000/- payable to the plaintiff. After part submissions, the learned counsel for the petitioner submits that the petitioner is ready and willing to make the payment of cost as imposed by the learned Trial Court, subject to further grant of 20 days time. 3.
He further submits that subject to grant of time to pay the cost, the petitioner does not want to press the present petition and seeks permission to withdraw the same.

The petition is dismissed as withdrawn with direction to the petitioner to pay the cost awarded by the learned Trial Court to the respondent herein on or before 05.03.2025.
