The Petitioner had submitted a complaint dated 14th October, 2024 to the Respondent - Central Bureau of Investigation1, making allegations against certain officials of Municipal Corporation of Delhi2 under the Prevention of Corruption Act, 19883. Since no action was taken on the said compliant, the Petitioner was constrained to file the instant petition, seeking following reliefs:

An appropriate order, direction, writ may be issued to the respondents under the aforesaid facts and circumstances of the case in good conscience, law of equity and in the interest of justice. 1 "CBI"

The respondents may be directed to comply with the provisions of Section 17-A of the Prevention of Corruption Act, 1988. (iii) The respondent no.1 may be directed to file status report upon complaint dated 14.10.2024 and take action upon the complaint dated 14.10.2024 in accordance with law."

Mr. Ashish Dixit, counsel appearing on behalf of Mr. Ravi Sharma, SPP for CBI, states on instructions that CBI has sent a representation dated 02nd December, 2024 to the MCD, requesting the grant of sanction under Section 17A of PC Act. He further states that as and when such a sanction is received, CBI will proceed further in the matter. 3.

In light of the above statement, considering the prayers sought in the present petition, no further directions are required to be passed by this Court. Respondent No. 2 - MCD is directed to take a decision on the said request of CBI dated 2nd December, 2024, as expeditiously as possible, in accordance with law. Further, the Petitioner shall be at liberty to take recourse to appropriate legal proceedings, subject to the outcome of the request for sanction made by CBI.

It is made clear that the Court has not commented on the merits of the case. All rights and contentions of the parties are reserved. 5.
