This is an application under Section 151 CPC, 1908 filed by the petitioner in person seeking permission to challenge the order dated 05.03.2024 passed by the Appellate Committee in an appeal dated 26.11.2018.

Keeping in view the fact that the fresh order has been passed by the Appellate Committee on 05.03.2024, no specific permission is required to be taken from this Court or granted. The challenge to such order are to be done in accordance with law.

The application is misconceived and dismissed as such. W.P.(C) 1054/2019 4.

in person submits that his alternate prayer seeking permission to withdraw the present writ petition with liberty to challenge the order dated 05.03.2024 passed by the Appellate Committee in his appeal dated 26.11.2018 be granted without prejudice to his rights and contentions raised in the present petition.

Since the order dated 05.03.2024 has been passed by the Appellate Committee in accordance with the statutory rules of the respondent-bank, the petitioner may challenge the same by way of substantive writ petition on the said cause of action. This, of course, would be without prejudice to the rights and contentions and other legal and territorial jurisdictional objection raised by the respondent and taken in its counter affidavit in the present writ petition. 6.

The petition along with all the pending applications, if any, is dismissed as withdrawn with liberty so sought granted. 7.

Next date 29.08.2024 stands cancelled.
