Petitioner has filed the present Writ Petition challenging the Order dated 29.12.2023.

The short ground on which notice was issued in the present matter was that the Appellant was not heard before passing the impugned order. 3.

It is stated by the learned Counsel for the Respondent that as per practice dates are informed telephonically and the Petitioner did not appear despite being informed, a fact which is not on record. 4.

In view of the fact that the Appellant has not been heard, with the consent of both the parties, the Order dated 29.12.2023 is set aside and the matter is remanded back to the Divisional Commissioner. The Appeal is restored to its original number.
