$~16 * IN THE HIGH COURT OF DELHI AT NEW DELHI + CRL.M.C. 142/2017 MRS AMITA NAVALKHA ..... Petitioner Represented by:

Mr Nalin Tripathi, Adv.

versus C B I ..... Respondent Represented by:

Mr. Narender Mann, Spl. PP with Mr. Manoj Pant, Adv.

CORAM:

HON'BLE MS. JUSTICE MUKTA GUPTA

O R D E R

% 22.03.2017 By the present petition the petitioner seeks quashing of proceedings arising out of RC No.4(S)/2011/SC-1/CBI/New Delhi dated 28th March, 2011 under Section 13(1/(d) read with 13(2) of the P.C. Act & 420/120B IPC.

The only ground urged seeking quashing is that despite the closure report having been filed on 28th February, 2013 which is also wrongly mentioned as 2012 no proceedings have taken place before the Trial Court and in view of the inordinate delay this Court be pleased to quash the proceedings.

When the matter came up before this Court on 13th January, 2017 though the petitioner was a party to Crl.M.C.4380/2016 being respondent No.2 therein and duly served, neither in the petition it was mentioned nor CRL.M.C. 142/2017

learned counsel pointed out that in Crl.M.C.4380/2016 this Court had stayed the order dated 23rd May, 2016 passed by the learned Trial Court directing production of the crime file as the learned Trial Court felt that the same was essential to the decision in respect of closure report. Petition is dismissed for concealment of facts. MUKTA GUPTA, J.
