The learned counsel appearing for the petitioner states that for the last three years arguments on charge have not been heard by the learned Trial Court. He further states that his liberty is at stake, therefore, the applicant be granted bail.

On the other hand, the learned APP for the State submits that considering the gravity of the offence and also taking note of the fact that the present case has been filed under Sections 409/201/380/381/457/120B/34 of the Indian Penal Code, 1860 read with Sections 3/9 of the Official Secrets Act, 1923, bail at this stage cannot be granted.

The Trial Court Record has been received which has been perused. 5.
A perusal of Trial Court Record reveals that adjournments in this case have been given liberally by the learned Trial Court and arguments on charge have not been heard for the last three years. The learned Trial Court is directed to ensure that the arguments on charge are heard and order thereon is passed within a period of three weeks from date. The DCP concerned will ensure that all the concerned Investigating Officers (IO) remain present before the learned Trial Court on the next date of hearing since the case had been adjourned due to non-availability of one or the other IO on multiple hearings.

In view of the above directions, the present application stands disposed of.
