BAIL APPLN. 242/2024 3.

The present application is filed under Section 439 of the Code of Criminal Procedure, 1973, seeking interim bail in FIR No.100/2017, dated 03.04.2017, under Sections 365/302/201/34 of the Indian Penal Code, 1860, registered at Police Station G.T.B Enclave on the ground that it is the death anniversary (Barsi) of the applicant's father, on 28.01.2024, and the presence of the applicant is needed for performance of rituals. 4.

The Status report has been handed over in court and the same is taken on record.

It is not disputed that the father of the applicant had expired on 28.02.2023. It is also not denied that the death anniversary (Barsi) of applicant's father is to take place on 28.01.2024.

It is pointed out that the applicant was earlier also granted interim bail and he had not misused the liberty. 7.

In view of the above, the applicant is directed to be released on interim bail for a period of three days, that is, from 26.01.2024 to 28.01.2024, on the following terms: (i) The applicant shall furnish a personal bond in the sum of Rs.20,000/- with one surety of the like amount, subject to the satisfaction of the concerned Jail Superintendent.

(ii) The applicant shall provide his mobile phone number to the Investigating Officer (IO) concerned - which shall be kept in working condition at all times. The applicant shall not switch-off, or change the mobile number without prior intimation to the IO concerned, during the period of bail;

(iii) The applicant shall not indulge in any criminal activity during the bail period.

The applicant is directed to surrender, before the concerned Jail Superintendent, on 29.01.2024, before 12:00 noon.
