Mr. Karan Sharma, who appears on behalf of the respondents, concedes that the captioned matter is covered by the following judgments : (i) Judgment dated 18.10.2019, passed in W.P.(C)No.8820/2019, titled Sir Chhotu Ram Jat College of Education Vs. National Council for Teacher Education & Anr.

(ii) Judgment dated 11.12.2019, passed in W.P.(C)No.13089/2019, titled R.C. Education Society and Anr. vs. National Council for Teacher Education & Anr.

To be noted, the following substantive prayers have been made in the writ petition:

"(a) Issue an appropriate writ(s)/direction(s) or order(s) including a writ of certiorari quashing and setting aside the impugned decision taken by the NRC in its 310th meeting held from to 20th to 22nd November 2019 whereby the NRC of NCTE has decided to reject the application submitted by the Petitioner for recognition of B.Ed, course; and/or W.P.(C) 13358/2019

(ii) Issue an appropriate writ(s)/ direction(s) or order(s) including a writ of certiorari quashing and setting aside the impugned letter dated 18.12.2018 issued by the NCTE; and/or (iii) Issue an appropriate writ(s)/direction(s) or order(s) including the writ of mandamus directing the respondents to process their application for grant of recognition of B.Ed, course without any reference to ban imposed by the State Government of Rajasthan on starting new B.Ed, course."

Given the stand taken by learned counsel for the respondents, the impugned decision of the Northern Regional Committee (NRC) taken in its 310th meeting held between 20th and 22nd November 2019 is quashed. 3.1 Furthermore, the impugned letter dated 18.12.2018 issued by the NCTE is quashed.

The respondents will, thus, process the petitioners' application for grant of recognition qua B.Ed. course without reference to the ban imposed by the concerned State Government i.e. the State Government of Rajasthan. Since petitioner no.2 institute is located in Rajasthan, in consonance with the gazette notification issued on 27.01.2020, if necessary, the petitioners' case will be transferred to the Western Regional Committee (WRC). 5.

The respondents are directed to act with due expedition keeping in mind that the cut-off date for academic session 2020-2021, which is, concededly fixed as 03.03.2020.
