By way of present petition filed under Article 227 of the Constitution of India read with Section 482 Cr.P.C., the petitioner has assailed interim order dated 03.09.2020 passed by the Trial Court and upheld by the learned ASJ vide order dated 13.12.2021.

Notably, the impugned order relates to interim directions given by the Trial Court wherein petitioner has directed to pay monthly maintenance of Rs.12,000/- to the complainant.

After some arguments, learned counsel for the petitioner states that since the impugned order only relates to interim maintenance and considering that the trial is still pending, he restricts the prayer only to the extent that adjustment of excess amount, if any, be granted to the petitioner at the conclusion of the trial.

In light of the same, present petition is disposed of with the directions that in case the Trial Court comes to a conclusion that excess amount towards maintenance has been paid by the petitioner, the same shall be adjusted while awarding the final maintenance, if any.
