O R D E R

The learned counsel for the petitioner states that the efforts to resolve the disputes amicably have not been successful as yet. In the circumstances, he requests for arbitral tribunal to be constituted. 2.

The learned counsel appearing for the respondents states that the respondents will, within a period of two weeks from today, suggest five names to the petitioner to enable the petitioner to nominate an arbitrator (from amongst those five persons). He states that after the petitioner has nominated an arbitrator, the respondent would also nominate its arbitrator from the remaining four persons within a period of two weeks thereafter. And, the said arbitrators would thereafter appoint the third arbitrator. 3.

In view of the above, no orders are required to be passed at this stage

except to observe that the respondents would ensure that the five names suggested by the respondents are persons who have no connection with the Indian Railways either as serving or as past employees. VIBHU BAKHRU, J MAY 16, 2017 RK
