% 21.10.2024 CS(OS) 49/2024 & I.A. 42620/2024 (joint application under Order 23 Rule 3 read with Section 151 CPC) 1.

The present application has jointly been filed by the parties praying for decreeing the suit in terms of the Settlement Agreement Dated 29.08.2024 arrived at between the parties before the Delhi High Court Mediation and Conciliation Centre.

It is averred in the application that during the pendency of the present suit this Court vide order dated 29.07.2024 had referred the parties to the mediation under the aegis of the Delhi High Court Mediation and Conciliation Centre, where the parties arrived at settlement, terms whereof have been reduced in writing in the form of Settlement Agreement dated 29.08.2024, a copy of which has been annexed as Annexure P-1 to the present The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. Learned counsel for the parties invites the attention of the Court to the copy of the Settlement Agreement dated 29.08.2024 which has been signed by the plaintiffs and the all the three defendants, as well as, by their respective counsel and the learned Mediator. The present application is also supported by the affidavit of all the parties.

I have gone through the Settlement Agreement dated 29.08.2024 and find that the terms of the same are lawful, therefore, there is no impediment in decreeing the suit in terms of the said Settlement Agreement. The parties shall remain bound by the terms of the aforesaid Agreement. 5.

In view of the above, the application is allowed and the suit is decreed in terms of the Settlement Agreement dated 29.08.2024 (Annexure P-1) which shall form part of the decree.

Let decree sheet be drawn, accordingly.

In view of the above, the application, as well as, the suit stands disposed of.
