The present petition has been filed seeking regular bail in connection with FIR No. 267/2024 under Sections 354/354B/451 IPC and Section 8 POCSO Act, registered at PS Sarita Vihar.

Mr. M. Hasibuddin, learned counsel appearing on behalf of petitioner submits that the petitioner is already on interim bail. 3.

He contends that the only allegation against the present petitioner is that he trespassed into the house of the complainant in inebriated condition and pulled her dupatta and also touched her breast in inappropriate manner and when she shouted, the petitioner got scared and ran away. 4.

He submits that the petitioner is already in custody since 07.08.2024 and the chargesheet stands filed.

examined, therefore, there is no possibility of petitioner influencing the witness in the event he is enlarged on bail. He further contends that the petitioner has already shifted from the neighbourhood of the prosecutrix. 6.

There is substance in the submission of Mr. Hasibuddin that since the prosecutrix and the complainant have been examined, there is no possibility of the petitioner exerting any pressure on them. 7.

It is not the case of the prosecution that the petitioner has any previous involvements or that he is a flight risk. 8.

Having regard to the aforesaid facts and circumstances, the nature of allegation, as well as, the custody period, this Court is of the view that the petitioner is entitled to regular bail.

Accordingly, the petitioner is admitted to regular bail subject to his furnishing a personal bond in the sum of Rs. 20,000/- with one surety of the like amount to the satisfaction of the learned Trial Court/JMFC/Duty JM, further subject to the following conditions:

(a) Petitioner shall appear before the Court as and when the matter is taken up for hearing.

(b) Petitioner shall provide mobile number to the IO concerned which shall be kept in working condition at all times and he shall not change the mobile number without prior intimation to the Investigating Officer concerned.

(c) Petitioner shall not indulge in any criminal activity and shall not communicate with or come in contact with the victim or any family members of the victim or other witnesses. 11.
