By way of this petition, the petitioner assails an order dated 12.01.2026, passed by the learned Additional Sessions Judge, Patiala House Court, New Delhi, by which the Court has granted interim protection to respondent Nos. 2 to 5 for a period of five working days, while holding that the Court had no jurisdiction to entertain bail applications on behalf of the said persons.

I have heard Mr. Sunil Dalal, learned Senior Counsel for the petitioner, and Mr. Sandeep Sharma, learned Senior Counsel for respondent Nos. 2 to 5.

The period of five working days for which respondent Nos. 2 to 5 were granted protection by the impugned order has already lapsed. Mr. Dalal therefore seeks a clarification, that the observations in the impugned order with regard to the merits of the bail applications will not influence the jurisdictional Court, in the event that any application is filed before the jurisdictional Court.

Mr. Sharma also accepts that this is a correct position in law. Surprisingly, he states that no application has been filed, despite the lapse of time for which the interim protection was granted. 5.

Although learned Senior Counsel on both sides have joined issue as to the legality of the order, I am of the view that the petition can be disposed of on the basis of the submission made by Mr. Dalal. 6.

The petition is disposed of with the direction that, if any application is filed before the jurisdictional Court, it will be considered on its own merits, uninfluenced by the impugned order, and having regard to all the facts and circumstances of the case.

The petition, alongwith the pending application, is disposed of in these terms.
