The petitioner has filed the present petition impugning the orders passed by the respondents, striking off the name of the petitioner from the Register of LLP. The principal grievance of the petitioner is that it was not afforded any opportunity of being heard before the action of striking off its name from the register of LLP.

The learned counsel appearing for the respondent readily accepts that the said action was contrary to Section 75 of the Limited Liability Partnership Act, 2008, and states on instructions that the name of the petitioner has since been restored on the register of LLP. He, however, states that the petitioner has not filed any return, and therefore is liable to be proceeded against.

Since, the petitioner's name has now been restored on the Register of LLP, no further orders are required to be passed in this petition. It is further
clarified that the respondent is not precluded from taking any action for the removal of the petitioner's name from the Register of LLP, albeit, in accordance with law. In the event any such action is proposed, the respondent shall give due prior notice for the same, and pass an appropriate order after affording the petitioner an opportunity of being heard. 4.
The petition is disposed of in the aforesaid terms. The pending application is also disposed of.
