By the present petition the petitioner seeks anticipatory bail in case FIR No.1490/2015 under Section 376 IPC registered at PS Dabri, Delhi. 2.

Learned counsel for the petitioner contends that the falsity of the allegations in the FIR is writ large and that the previously also the complainant levelled similar allegations against another accused and got the FIR registered. Further the husband of the complainant also got registered a FIR against a third person for an offence under Section 376 IPC through one Simran claiming to be his wife.

Learned APP for the State has taken me through the status report as per which the allegations against the petitioner are that the complainant was BAIL APPLN. 51/2016

receiving calls from a mobile phone in which regard she made a complaint to her husband however, again when she received a call the person introduced himself as Amarjeet, apologised and requested her to talk to him. On the request of Amarjeet she went to Vikaspuri where a servant of Amarjeet received her at Tilak Pul Uttam Nagar from where she was taken on a scooty to the flat of Amarjeet where he sent the servant out and raped her.

Considering the allegations made in the FIR and the fact that earlier also similar complaints were made by the complainant and by her husband implicating different persons, I deem it fit to grant anticipatory bail to the petitioner. It is, therefore, directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount, subject to the satisfaction of the Arresting Officer/SHO concerned, further subject to the condition that he will join the investigation as and when directed by the Investigating Officer and will not leave the country without prior permission of the court concerned.
