BAIL APPLN. 21/2017 The submission of learned counsel for the petitioner is that the relationship between the petitioner/ accused and the complainant/ prosecutrix was consensual. He further submits that the issue whether the petitioner had made any promise to marry the prosecutrix at the initial stage
of the relationship, and even if such a promise was made, whether the petitioner has resiled from that, is a matter of trial. He submits that the petitioner is ready & willing to join the investigation. Let the petitioner join the investigation, firstly, on 07.01.2017 at 02:00 p.m. before the I.O., and all such other dates as may be fixed by the I.O. The petitioner shall also cooperate in the investigation. Subject to the compliance of the aforesaid terms, it is directed that the petitioner shall be released on bail in case of his arrest upon furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the arresting officer. This is further subject to the condition that the petitioner shall not seek to influence any of the witnesses or tamper with any evidence. The petition stands disposed of in the aforesaid terms.
