Applicant-Aarti is seeking anticipatory bail in FIR No. 0534/2025 under Sections 318(2)(4)/337/338/336(3)/340(2)/61(2)/3(5) BNS 2023 (corresponding Sections 420/466/467/468/471/120B IPC) registered at P.S. New Ashok Nagar, East District.

The abovesaid relief was denied by the learned Court of Sessions and, when the matter was pending before the learned Court of Sessions a Status Report was submitted. Copy thereof has been annexed with the present petition also.

According to complainant, he had met accused-Deepak Kumar (already arrested) in MCD office. He introduced himself as an employee of MCD and supplemented that he was well acquainted with senior officers in BAIL APPLN. 237/2026 1 The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.
MCD and could provide a job to complainant under the "Physically Disabled Quota".

After gaining trust of the complainant, accused-Deepak demanded Rs.5 lakhs for the job in question. Believing him, the complainant initially gave him Rs.2.80 lakhs in advance and, thereafter, accused-Deepak, and his one associate-Vicky, gave him an appointment letter. 5.
Pursuant to the above, the complainant gave the balance amount to them. The complainant, being assured about the genuineness of such appointment letter, introduced several other persons to accused-Deepak and, eventually, they all learnt that they had been cheated. 6.
As far as accused-Deepak is concerned, he has already been arrested and is running in judicial custody.

The applicant herein is wife of accused-Deepak and according to I.O. i.e. Insp. Sandeep Kaalkhande, who is present in Court, as per the investigation done so far, there is complicity of applicant-Aarti also as she is the one who had put forged signatures on all such appointment letters. 8.
According to prosecution, the recovery of fake stamps has to be effected at the instance of applicant from her house. Admittedly, when accused-Deepak i.e. her husband was arrested and police custody remand was taken, the house of accused-Deepak, where Applicant-Aarti is also residing, was searched.

The applicant is in her late twenties, with no previous involvement. 10.
Keeping in mind the overall facts of the case, the application is allowed with the following directions:- i.
The applicant would join the investigation as and when so directed by the concerned SHO/IO.

ii.
In case she does not co-operate, she would, automatically, become disentitled to the relief granted by this Court. 11.
In the event of her arrest, she be released on bail by arresting officer upon her furnishing personal bond and surety bond in a sum of Rs. 25,000/-. 12.
