Petitioner seeks expeditious disposal of her Execution Petition i.e. Execution Petition (Criminal) No.2/2025.

As per the order dated 12.09.2024, the petitioner and her 14 years old son have been granted maintenance @ Rs.10,000/- p.m. from the date of the petition.

The petition was filed in the year 2019.

It is submitted that till date, the respondent husband has only paid a sum of Rs.30,000/-.

It is submitted that despite the fact that respondent is teacher in a private school and had even shown his salary slip to the Court, there is no direction regarding attachment of his salary. 6.

The next date before the learned Executing Court is stated to be 07.03.2026.

After hearing arguments for some time, learned counsel for petitioner, without prejudice to her rights and contentions, does not press the present petition. She, however, seeks liberty to file application seeking preponment in the date so that the needs of the petitioners are duly taken care of as they are finding it difficult to make ends meet and their very survival is at stake, and they are at the verge of vagrancy and destitution. 8.

The petition is, accordingly, disposed of as not pressed. 9.

However, simultaneously, the petitioner is granted liberty to move appropriate application before the learned Judge, Family, Court seeking preponment in the date of hearing and, in case any such application is moved, after giving due notice to the opposite side, the learned Trial Court shall make best endeavour to not only dispose of the abovesaid application but also the entire execution petition.

All rights and contentions of the parties are, however, reserved. 11.

The pending applications are also disposed of in aforesaid terms.
