By virtue of the present petition under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the petitioners seek quashing of FIR No.006222/2025 dated 27.02.2025 registered under Sections 305(b) of the Bharatiya Nyaya Sanhita, 2023 (BNS) at PS: e-Police Station (Sadar Bazar), Crime Branch, Delhi, and all proceedings emanating therefrom, in view of the Settlement Deed dated 09.10.2025 arrived at between the petitioner and the respondent no.2. 2.
The present petition is also accompanied by the said Settlement Deed dated 09.10.2025 as Annexure 2 and is also supported by affidavit(s) of the petitioner and respondent no.2 alongwith proofs of their respective The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Learned APP for the State accepts notice, and submits that he has no objection to the quashing of the aforesaid FIR No.006222/2025 dated 27.02.2025.

Respondent no.2, present in Court, also accepts notice and confirms the terms of the Settlement Deed dated 09.10.2025 by virtue whereof he had already recovered scooty and a sum of Rs.3,600/- has already paid to him by the petitioner as full and final settlement of all his claims. He thus confirms that all disputes inter se the parties stand amicably settled in view of Settlement Deed dated 09.10.2025. Lastly, respondent no.2 states that he has no objection to the quashing of the FIR No.006222/2025 dated 27.02.2025.

Further, the petitioners and the respondent no.2, present in Court, as well as their credentials, as on record, have been identified by the Investigating Officer.

Though the petitioner has been charged with offence under Section 305(b) of the BNS, which ordinarily requires this Court to be careful in quashing such proceedings/ FIRs, however at the same time, this Court cannot shut its eyes to the practical realities of securing a conviction in the present case, particularly whence the respondent no.2 has duly entered into an Settlement Deed dated 09.10.2025 with the petitioner, and is no longer inclined to support the case of the prosecution. Under such circumstances, considering the age of the petitioner, who have a future ahead, it would be in the public interest for this Court, in the exercise of its inherent powers under Section 528 BNSS, to quash the proceedings. As such, following the law laid down by the Hon'ble Supreme Court in Jitendra Raghuvanshi & Ors. vs. Babita Raguvanshi & Anr. (2013) 4 SCC 58, Gian Singh vs. State of Punjab & Anr. (2012) 10 SCC 303 and Narinder Singh & Ors. vs. State of Punjab & Anr. (2014) 6 SCC 466, this Court is of the opinion that continuation of the aforesaid FIR No.006222/2025 dated 27.02.2025 will be an exercise in futility. 9.
Accordingly, the present petition is allowed and FIR No.006222/2025 dated 27.02.2025 registered under Sections 305(b) of the Bharatiya Nyaya Sanhita, 2023 (BNS) at PS: e-Police Station (Sadar Bazar), Crime Branch, Delhi, and all proceedings emanating therefrom are quashed.

Accordingly, the petition alongwith pending application is disposed of.
