Crl. M.A. No.12682/2016 (modification) By the present application the petitioner seeks modification of the order dated 17th February, 2016 seeking reduction in the surety amount as he is unable to furnish the surety.

Issue notice.

Learned Additional Standing Counsel accepts notice on behalf of the State.

A perusal of the status report reveals that the petitioner has roots in the society. The sister of the petitioner is residing at D-2/25A, D-2 Block W.P.(CRL) 54/2016

Vijay Enclave, Vinod Puri, Delhi and stated that the petitioner will be residing with her if released on parole.

A perusal of the nominal roll reveals that the petitioner was earlier granted parole which concession he did not misuse. In the earlier parole order granted on 10th December, 2012 in W.P.(CRL) 1693/2012 the petitioner was directed to furnish a personal bond of `10,000/- with one surety of the like amount.

Considering the facts noted above the order dated February 17, 2016 is maintained modifying condition No.(i) directing him to furnish a personal bond of `25,000/- to a personal bond of `10,000/- with one surety of the like amount to the satisfaction of the learned Trial Court concerned. Remaining conditions would be retained.

Application is disposed of.

Copy of the order be communicated to the petitioner through Superintendent Tihar Jail.
