Application under Section 151 of the Code of Civil Procedure, 1908 (hereinafter referred to as 'CPC') has been filed on behalf of the Respondent/Decree Holder for release of the deposited amount by the Appellant to the REspodent/Decree Holder.

It has been submitted that the accompanying Appeal preferred by the Appellant, has been dismissed on 30.03.2026 and the decretal amount that was deposited by the Appellant pursuant to the Order dated 20.02.2023, be released to the Respondent.

Considering that the accompanying has already been dismissed on 30.03.2026, the decteal amount as deposited by the Appellant, be released to the Respondent subject to his filing an Affidavit that there is no further Appeal or any other remedy preferred by the Appellant against the Judgment of this Court dated 30.03.2026.
