O R D E R

% 27.02.2025 As recorded in order dated 20.01.2025, learned counsel appearing on behalf of the Directorate of Enforcement ('ED') had submitted before this court, that they entertained a doubt as to whether the petitioner had at all undergone spinal surgery, on which ground interim bail was granted to him.

Today however, Mr. Vivek Gurnani, learned counsel appearing on behalf of the ED submits, that their suspicion was based only on the statement of a lab-technician, who had conducted the MRI of the respondent. Counsel however submits, that the doubt has not been substantiated by any other material.

In the circumstances, learned counsel submits, that since the extension of interim bail granted to the respondent has since run-out, and he is to surrender back to custody tomorrow i.e. 28.02.2025, the present petition has been rendered infructuous; and may be disposed-of as such.

Mr. Vikas Pahwa and Mr. Abhimanyu Bhandari, learned senior counsel appearing on behalf of the respondent state that the respondent has applied for further extension of interim bail on medical grounds, which application is listed before learned Special Judge tomorrow; and pray that it be clarified that the said application would be considered by the learned Special Judge independent of what has transpired before this court in the present proceedings. 5.

In view of the above, and in the interest of fairness and justice, it is directed that the learned Special Judge would consider any application seeking extension of interim bail filed before that court independently of the proceedings before this court in the present matter. 6.

In view of the foregoing the present petition is disposed-of as infructuous.
