Allowed, subject to all just exceptions. This application is disposed of. CM(M) 157/2026 3.

The present petition under Article 227 of the Constitution of India, 1950 seeks the following prayers: - <a) Grant ad-interim, ex-parte order that the Respondent shall abide by Settlement order dated 29.03.2023 passed Mediation Centre, Saket Courts, New Delhi in G.P. No. 12 of 2023 till the same is modified.

b) Direct the Respondent to bring the children before this Hon'ble Court, in order to assess the well being and mental health of the children.

c) Direct the Family Court to decide the Application for modification of the Settlement order dated 29.03.2023 within 30 days or in the alternate, it is humbly prayed that this Hon'ble Court may be pleased to pass orders regarding temporary custody of children and visiting rights of parties that are in the best interest and well being of the children;

d) Pass any such order(s) as this Hon'ble Court may deem fit and proper.= 4.

respondent is not abiding by the terms of the settlement order dated 29.03.2023 passed by the learned Mediator, Mediation Centre, Saket Court. She further submits that an application seeking modification of the terms of said settlement order has been filed, which is now listed before the learned Family Court on 15.02.2026, with the following prayers: - <A. Fix an early date for hearing of the application seeking modification of the settlement order dated 29.03.2023; B. Call upon the Respondent to produce the children before the Hon'ble Court;

C. Till the disposal of the application seeking modification of the settlement order, as an ad-interim measure, the Respondent to continue to abide by the visitation rights granted to the Petitioner; D. Pass any other and further order, as may be deemed just and proper in the circumstances of the present case;= 5.

Learned counsel for the petitioner further submits that the latter last met her children on 10.01.2026 and thereafter, she is unable to meet her children. 6.

In these circumstances, the present petition is disposed of with liberty to the petitioner to move an appropriate application seeking pre-ponement of the date fixed by the learned Family Court as well as for production of children for necessary interaction.

On such an application being moved, learned Family Court is requested to decide the same in accordance with law.

No further directions are called for.
