The present petition under Section 528 of the BNSS seeks the following prayers:

"It is, therefore, most respectfully prayed to this Hon'ble Court that keeping in view the facts and circumstances of the petition the Hon'ble Court may kindly be pleased to quash the FIR NO. 693/2019 DATED 06/12/2019, P.S. UTTAM NAGAR, 'NEW DELHI alongwith all the consequent proceedings emanating therefrom in the interest of justice;

Or ; pass any other order which may deems fit to this Hon'ble court in the interest of justice."

Learned counsel appearing on behalf of the petitioner submits that the matter has been settled with respondent no. 2. An MoU dated 13.11.2024 has been entered between the petitioner and respondent no. 2. It is pointed out that the co-accused persons, namely, Hari Om and Govind Gupta had already settled the matter with respondent no. 2 and vide order dated 06.11.2024 in CRL. M.C. 8469/2024 by a coordinate Bench of this Court, the present FIR qua them has been quashed.

It is pointed out that the present petitioner was a CCL at that relevant point of time and an inquiry is pending before JJB-VII, Sector-8, Dwarka, Delhi.

A statement of respondent no. 2 has already been recorded before the worthy Joint Registrar on 20.01.2025. Vide order dated 07.02.2025, it was further recorded that a DD of Rs. 50,000/- had been given to respondent no. 2, which stood duly realised.

Petitioner and complainant/respondent no. 2 are present before the Court and have been duly identified by the Investigating Officer, SI Bharat Singh, P.S. Uttam Nagar.

The complainant/respondent No.2 states that the matter has been settled with the petitioners and he has no objection if the FIR is quashed. 9.

In view of the settlement between the parties, learned APP for the State also has no objection if the present FIR is quashed. 10.

In Gian Singh v. State of Punjab, (2012) 10 SCC 303, the Hon'ble Supreme Court has recognized the need of amicable resolution of disputes by observing as under:- "61. ... proceedings would tantamount to abuse of process of law despite settlement and compromise between the victim and the wrongdoer and whether to secure the ends of justice, it is appropriate that criminal case is put to an end and if the answer to the above question(s) is in the affirmative, the High Court shall be well within its jurisdiction to quash the criminal proceeding." 11.

In view of the aforesaid circumstances, and the fact that the parties have put a quietus to the dispute, no useful purpose will be served in continuing with the present FIR No. 693/2019, under Sections 325/341/506/394/34 of the IPC, registered at P.S. Uttam Nagar and all other consequential proceedings emanating therefrom, including the enquiry pending before the before learned JJB-VII, Sector- 8, Dwarka, Delhi.

In the interest of justice, the petition is allowed, and the FIR No. 693/2019, under Sections 325/341/506/394/34 of the IPC, registered at P.S. Uttam Nagar and all other consequential proceedings emanating therefrom, including the enquiry pending before the before learned JJB-VII, Sector- 8, Dwarka, Delhi is hereby quashed.

Petition is allowed and disposed of accordingly. 14.
