Writ petition under Article 226 of the Constitution of India read with Section 482 of the Code of Criminal Procedure, 1973 ('Cr.P.C.') has been preferred on behalf of the petitioner for quashing of FIR No. 0488/2023, under Sections 288/337/338 IPC, registered at P.S.: Najafgarh and proceedings emanating therefrom. Section 304A IPC has been invoked subsequently.

Learned ASC for State informs that the case is still under investigation. On instructions of IO, he further submits that an endeavour shall be made to file the final report within a period of 60 days from today. At this stage, learned counsel for petitioner seeks to withdraw the petition with liberty to file afresh after filing of final report. 4.

Pending applications, if any, also stand disposed of. Nothing stated herein shall tantamount to expression of an opinion on the merits on the case.
