By an order dated 15.10.2024, it was recorded as follows:- "1.

There is no appearance on behalf of the appellant when the matter is taken up for hearing.

By order dated 31.08.2022, it was recorded that the appellant has expired during the pendency of the proceedings. It was submitted that an application for substitution of the deceased appellant had already been filed, but it was not found to be on record. No such application is on record even today and the appellant has not been represented in the proceedings since 02.02.2023. 3.

In these circumstances, Court Notice be issued to the learned counsel on record for the appellant for the next date of hearing. 4.

List on 04.12.2024.

PS : Later Mr. Sharvan Dev, learned counsel, enters appearance on behalf of the appellant and has been apprised of the next date of hearing. The direction for issuance of Court Notice to learned counsel for the appellant is, therefore, recalled."

When the matter is taken up today, there is no representation on behalf of legal heirs of the appellant. No application has been filed for substitution of the deceased appellant.

The appeal is therefore dismissed, as the appellant has passed away and no application has been made for substitution by her legal heirs.
