Mr.

Divyanshu Phate, Advocates versus STATE NCT DELHI .....Respondent Through:
Mr. Ajay Vikram Singh, APP for State with SI Mohit
CORAM:
HON'BLE MR. JUSTICE PRATEEK JALAN
O R D E R
% 20.02.2026 1.
After some hearing, Mr. Bhavdeep Singh, learned counsel for the petitioner, seeks permission to withdraw the present bail application, with liberty to move the Sessions Court at an appropriate stage. 2.
Mr. Singh, however, draws my attention to an order dated 09.09.2025, by which an earlier application for bail [BAIL APPLN. 3441/2025] was withdrawn with liberty to file afresh after arguments on charge were heard. However, he submits that arguments on charge have not been heard despite the lapse of a period of five months since then. 3.
Mr. Ajay Vikram Singh, learned Additional Public Prosecutor, submits that the matter is fixed for arguments on charge on 23.02.2026, and the prosecution will take all steps to cooperate with the Sessions Court for expeditious progress of the proceedings. 4.
In view of the above, the application is dismissed as withdrawn, in terms of the above submissions.
