Learned counsel for the petitioner submits that since the objections under Section 34 of the Arbitration and Conciliation Act, has been finally decided, the present Petition challenging the Order under Section 5 of the Limitation Act, 1963, has become infructuous. 2.

Without prejudice to the rights and contentions raised in the present Petition, the Petition is disposed of with liberty to raise these contentions in case the Appeal under Section 37 of the Arbitration and Conciliation Act is filed by the respondent.
