The Petitioner is a registered Public Charitable Trust representing medical professionals across India. It asserts that it espouses the collective cause of eligible candidates who participated in a centralised recruitment process for appointment to the post of Senior Resident under the Government of NCT of Delhi. It is further stated that several members of the Petitioner are presently serving as Senior Residents on an ad-hoc basis in Government hospitals and medical institutions. 2.

At the outset, Mrs. Avnish Ahlawat, SC (GNCTD Services), raises an objection to the maintainability of the present petition. Administrative Tribunal under the Administrative Tribunals Act, 1985. Reliance is placed on the decision of the Supreme Court in L. Chandra Kumar v. Union of India1 to submit that the Tribunal is the forum of first instance and that an efficacious alternative remedy is available. 3.

In view of the above objection, Dr. Charu Mathur, counsel for the Petitioner, on instructions, seeks leave to withdraw the present petition with liberty to avail other appropriate remedies, in accordance with law, before the Central Administrative Tribunal.

The petition is dismissed as withdrawn with liberty as aforesaid. 5.

All rights and contentions of the parties are kept open. The Court has not commented on the merits of the case.
