Petitioner is defendant before the learned Trial Court and is aggrieved by the fact that his application moved under Order VII Rule 11 CPC was wrongly dismissed by the learned Trial Court on 21.12.2023.

However, there is a significant development thereafter as Sh. Chaudhary, learned counsel for the petitioner has himself informed this Court that the suit as such has been decided and a final decree has already been passed on 24.01.2024. He states that since no proceeding is pending before the learned Trial Court, he may be permitted to withdraw the present petition, supplementing further that when the petitioner would challenge the final decree, it may be permitted to challenge the order which has been impugned herein. 3.

In view of aforesaid fact, the present petition is dismissed as not pressed. Liberty, as prayed, is granted.
