At the very outset, learned counsel for the petitioner states that there is subsequent development and, therefore, he may be permitted to withdraw the present petition.

Petitioner is defendant before the learned Trial Court and was aggrieved by the order whereby his application seeking setting aside of ex parte order was dismissed. However, it is now apprised that in the meanwhile, the suit has been decreed, albeit, in part. 3.
Mr. Mukesh Goyal states that he may be permitted to withdraw the present petition with the liberty that as and when he challenges the impugned decree, he may be permitted to challenge the order impugned in the present petition as well.

In view of the aforesaid development, present petition is dismissed as not pressed. Liberty, as prayed, is granted.
