Evidence in these suits which have been consolidated is going on before the Local Commissioner. Evidence of the plaintiffs in CS(OS) 275/2009 is complete. Evidence of the defendants and who are the plaintiffs in the connected suit is going on before the Local Commissioner. Accordingly, though these suits are transferred to the concerned jurisdictional court in terms of the present order, however, in order to avoid any administrative handicap in completing the evidence which is going on before the Local Commissioner a long date is given for CS(OS) 275/2009& conn.

appearance of the parties before the concerned District and Sessions Judge so that in the meanwhile parties who have agreed will complete the evidence before the Local Commissioner. Local Commissioner will now fix the dates for recording of evidence.

Since this Court does not have pecuniary jurisdiction in view of the Office Order dated 24.11.2015 issued by Hon'ble the Chief Justice in exercise of powers conferred by Section 4 of the Delhi High Court (Amendment) Act, 2015, whereby ordinary suits which are not commercial matters having pecuniary jurisdiction up to the value of rupees two crores cannot be tried by this Court and commercial matters up to the value of rupees one crore cannot be tried by this Court, these suits are transferred for decision to the jurisdictional Court under the District & Sessions Judge(West), Tis Hazari Courts, Delhi. 2.

Let parties appear before the District & Sessions Judge(West), Tis Hazari Courts, Delhi on 8th July, 2016. Suit file be made available to the District & Sessions Judge(West), Tis Hazari Courts, Delhi. on the date fixed. VALMIKI J. MEHTA, J JANUARY 08, 2016 ib CS(OS) 275/2009& conn.
