O R D E R

% 17.10.2019 By the present petition, the petitioner is seeking grant of bail in the event of his arrest in case FIR No. 220/2019 registered at PS Crime Branch, New Delhi.

On the last date of hearing i.e., 30.09.2019, the petitioner had handed over a cheque for a sum of Rs.25 lakhs to the complainant with an understanding that the total amount due towards the complainant shall be paid within a short period.

Today, learned senior counsel appearing on behalf of the petitioner has handed over four PDCs bearing no.78162 dated 05.02.2020 for a sum of Rs.25 lakh, bearing no.78164 dated 05.12.2020 for a sum of Rs.25 lakh, bearing no.78165 dated 05.11.2020 for a sum of Rs.23,50,00/- and bearing no.78163 dated 05.01.2020 for a sum of Rs.25

lakh, totalling Rs.98,56,000/- and submits that the cheques will be honoured and in case any of the PDC is dishonoured, the Court may take adverse view against the petitioner.

The investigating officer is accordingly directed to release the petitioner on bail in the event of arrest on him furnishing a personal bond in the sum of Rs.50,000/- with one surety in the like amount to his satisfaction. This bail application is allowed and disposed of accordingly. It is however made clear that if any of the terms of bail is violated by the petitioner, the respondent/complainant shall be at liberty to get the present petition revived.

Mr. Mittal, learned senior counsel for the petitioner, on instructions submits that petitioner is ready to pay another sum of Rs.5 lakhs to the complainant towards interest. The complainant, who is present in the Court, accepts the same and submits that if the total amount comes in his account, he will have no objection to quashing of the FIR and will cooperate in quashing of the FIR and proceedings emanating therefrom. At this stage learned counsel for the petitioner has handed over another cheque bearing no.78166 dated 05.02.2020 for a sum of Rs.5 lakh towards interest.
