The present petition under Section 14(1)(b) read with Section 15 of the Arbitration and Conciliation Act, 1996 seeking substitution of the Ld. Sole Arbitrator - Mr. Jagmohan Sabharwal, Senior Advocate, with an alternate Arbitrator.

Material on record indicates that disputes had arisen between the parties under a Master Services Agreement dated 07.09.2016 and the Petitioner filed a petition being ARB.P. 816/2017 before this Court for appointment of an Arbitrator to adjudicate upon the disputes between the parties. This Court vide Order dated 05.02.2018 had appointed Mr. Jagmohan Sabharwal, Senior Advocate, as a Sole Arbitrator. 3.

continue with the arbitration proceedings on account of his ill health and, therefore, the Petitioner has filed the present petition for appointment of a substitute Arbitrator.

It is stated by the learned Counsel for the Petitioner that the arbitration proceedings are at the stage of final arguments. 5.

This Court is inclined to appoint Ms. Tamali Wad, Sr. Advocate (Mob No.9810025306) as a substitute Arbitrator to further adjudicate upon the disputes between the parties.

It is for the substituted Arbitrator to decide whether to proceed with the final arguments after looking into the records of the case or to proceed de novo. The fees be, therefore, fixed accordingly as per the fee schedule fixed by the DIAC.
