By way of present petition, the petitioner seeks setting aside of the summoning order dated 25.05.2022 passed in Complaint Case No.23261/ 2016 titled 'Ravinder Kaul vs. Kamlesh Rana' pending before learned Metropolitan Magistrate, Patiala House Courts, New Delhi District, Delhi as well as quashing of the Complaint Case itself. 2.

Learned counsel for the petitioner submits that the petitioner's husband was the complainant in a case against respondent No.1 arising out of the same incident, in which respondent No.1 stands convicted. He further submits that in the present case, the summons came to be issued belatedly after about 11 years from the date of the incident. 3.

At this stage, learned counsel for respondent No.1 submits that the matter is listed before the concerned court on 15.07.2024, on which date The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above. respondent No.1 would be withdrawing his complaint against the petitioner. 4.

In view of the aforesaid statement, learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to revive the same, in case the need so arises.

Leave and liberty, as prayed for, are granted. The petition is dismissed as withdrawn alongwith pending application.
