This Court had appointed Justice R. K. Gauba, Former Judge of this Court as the Arbitrator vide Order dated 25.01.2024 to adjudicate upon the disputes between the parties. The office note indicates that the Ld. Arbitrator has sent an email 09.01.2025 stating that the arbitral proceedings have been terminated in terms of Section 38(2) of the Arbitration and Conciliation Act, 1996 on account of continue default in deposit of arbitration fees and charges as per DIAC Rules and also failure of appearance on behalf of the Claimant and disinclination to prosecute expressed by the Respondent. 3.

Since the Claimant seems to be disinterested in pursuing the petition, no further Orders are necessary to be passed in the present petition. 4.
