This petition has been filed in public interest and challenge was made to the advertisement issued on 24th November, 2017 by respondent No.2 in the matter of reservation of shops to ex-servicemen and their family members. Now by a subsequent advertisement/policy issued on 7th February, 2018, 100% reservation in allotment of regimental shops has been granted to the ex-servicemen and their family members. 2.

That being so as far as this writ petition is concerned, the same is rendered infructuous and is accordingly dismissed. 3.

We are informed today that the new advertisement issued on 7th February, 2018 has been challenged by way of a writ petition and some stay

has been granted by a Single Bench of this Court. If that be so, the parties are at liberty to approach the writ Court and get the issue sorted out in the pending writ petition. That apart, if there is any dispute subsisting between the petitioner, ex-servicemen or their family members or legal heirs or the private persons who have been allotted shops, it is a separate cause of action and all are granted liberty to take recourse to the remedy available to them in accordance with law for redressal of their grievance. 4.

We have simply disposed of the matter as having rendered infructous granting certain liberty to the parties to ventilate all their grievances before the appropriate forum and have not expressed any opinion on the merits of such rival claims, which according to us is not the subject in issue in this petition.
