Application filed on behalf of the Appellant seeking withdrawal of the Appeal.

The Appellant is present in person, who submits that the litigation is exorbitantly expensive for him to pursue and seeks permission to withdraw the present Appeal.

Reply as been filed on behalf of Respondent No. 4(D)-Ankit Mann wherein an objection is taken to withdrawal of the Appeal on the ground that the Appeal has defective affidavit and they have not been notarised property by the Oath Commissioner and that there is concealment of material facts from the Court and malpractices had been adopted by the Appellant in filing the Appeal. There is no provision under CPC, which permits the Respondent to oppose the unconditional withdrawal of the Appeal except that they can seek the imposition of cost.
