O R D E R

% 12.01.2017 This is a petition under Section 11 of the Arbitration and Conciliation Act, 1996 (hereafter 'the Act'), inter alia, for appointment of an arbitrator to adjudicate the disputes that have arisen between the parties. The present petition was heard on 04.01.2017. On that date, it was pointed out by the learned counsel for the respondent that the petitioner had already raised disputes in relation to the contract in question, which were pending adjudication before the Sole Arbitrator, Mr A.K. Singhal, DG (W) CPWD (Retd.).

Accordingly, the learned counsel for the respondent was directed to take instructions whether the dispute could be referred to the same Arbitrator as appointed earlier.

Learned counsel for the respondent states that he has received instructions from the competent authority of the respondent and the respondent is agreeable that the disputes involved in the present case may ARB.P. 5/2017

also be referred to Mr A.K. Singhal, who is already adjudicating the disputes between the parties. It is so directed.

The learned counsel states that the petitioner shall file its statement of claims before the Arbitrator within a period of four weeks. The respondent would also be at liberty to file its counter claims. It is clarified that all contentions of the parties are reserved.

The petition is disposed of.
