Written Submissions have not been filed on behalf of the Appellant in terms of Order dated 21.01.2025.

The Respondent has appeared in person and endorsed that she would not press for recovery of mesne profits in case the Appellant hand overs the possession.

The Appellant also undertakes to vacate the premises within 02 months.

In view of the submissions made by the Appellant and also the consent of the Respondent, the Regular Second Appeal is disposed of in terms of Settlement inter se the parties according to which, the Appellant shall hand over the peaceful and vacant possession to the Respondent in two months from today.

The Respondent/landlord shall not claim any mesne profits from the Appellant in lieu of getting the possession.
