CRL.M.C. 530/2026 & CRL.M.A. 2151/2026 (stay) By way of the present petition filed under section 528 of the Bharatiya Nagarik Suraksha Sanhita 2023, the petitioner (accused) impugns judgment dated 03.01.2026, by which order the learned Additional Sessions Judge-03, South-East District, Saket Courts, Delhi has allowed Cr. Rev. No.400/2025 filed by the petitioner, overturning order dated 30.05.2025 passed by the learned JMFC (NI Act)-01, South-East District, Saket Courts, New Delhi, in complaint bearing Ct Cases No.12806/2017.

By order dated 30.05.2025, the learned JMFC had closed the petitioner's opportunity to lead defense evidence in the case. The matter relates to dishonor of a cheque, for which the petitioner is facing proceedings under section 138 of the Negotiable Instruments Act, 1881; and the cheque amount is Rs.4,67,914/-. 4.

Learned counsel appearing for the petitioner submits that though the criminal revision petition has been allowed in the petitioner's favour, while granting to the petitioner "one effective opportunity to lead and conclude his defence evidence before the Ld. Trial Court," the learned ASJ has imposed upon the petitioner costs of Rs.20,000/- payable to the respondent (complainant).

Learned counsel submits, that the petitioner simply does not have the wherewithal to pay the costs imposed.

In view of the limited nature of the relief sought, it is not considered necessary to issue notice on the present petition. 7.

The petition is disposed-of, reducing the costs imposed by the learned ASJ vide judgment dated 03.01.2026 from Rs.20,000/- to Rs. 5,000/-, to be paid by the petitioner to the respondent within 04 weeks. 8.

The petitioner is directed to appear before the learned trial court on 23.01.2026, the date already fixed before that court. 9.

Pending applications, if any, stand disposed-of. 10.
