The present writ petition has been filed seeking a direction to the respondent to issue 'No Objection Certificate' in respect of the vehicle of the petitioner which is a diesel vehicle older than 10 years. 2.

In terms of the direction passed by the Supreme Court in M.C Mehta v. Union of India, W.P.(C) 13029/1985 [order dated 29th October, 2018], diesel vehicles older than 10 years cannot ply within the NCT of Delhi . 3.

The petitioner has sold his vehicle to a buyer, who is a resident of District Malappuram, State of Kerala, where no such prohibition exists. The petitioner seeks NOC from Delhi Regional Transport Office ('RTO') so that the buyer can get his vehicle registered in District Malappuram, State of Kerala.

submits that the respondent can only issue NOC in respect of the applicants who apply through their online portal, VAHAN. It is stated that the State of Kerala is not included in the list of states for which the NOC can be given. She further submits that there are at least 10 states in respect of which NOCs can be given through VAHAN, which include neighbouring states of Delhi, such as Rajasthan and Uttar Pradesh.

In my considered view, there is no vested right in the petitioner to seek grant of NOC from the respondent for the sale of his vehicle to a buyer in Kerala when it is an admitted position that the said vehicle can only be operated in certain districts of Kerala. It is not for the respondent to determine as to which districts in Kerala permit operation of diesel vehicles older than 10 years.

In these circumstances, the relief sought by the petitioner in the present writ petition cannot be granted. There is no merit in the petition and the same is dismissed.
