The present petition under Section 25-B, Sub-Section 8 of the Delhi Rent Control Act, 1958 seeks the following prayers: - "(a) Call for the records of eviction petition bearing no. RC ARC 634/19 , titled as SMT. SURINDER KUMARI versus SH. UDAIBIR SINGH CHAUHAN @ UDAIVEER SINGH u/s.
14(1)(e) read with section 25-b of DRC Act in respect of property no. SK-58A, Sindhora Kalan, delhi-110052 and/or; (b) Set aside the Impugned Judgment Order dated 19.08.2025 passed by Shri BHARAT AGGARWAL, ACJ-CUM-ARC, CENTRAL DISTRIC, TIS HAZARI courts, Delhi, in eviction petition bearing no. RC ARC 634/19, titled as SMT. SURINDER KUMARI versus SH. UDAIBIR SINGH CHAUHAN @ UDAIVEER SINGH u/s. 14(1)(e) read with section 25-b of DRC Act in respect of property no. On 19.03.2026, this Court passed the following order: - "RC.REV. 24/2026 & CM APPL. 4251/2026
3. During the course of arguments, learned counsel for the petitioner submits that the latter shall vacate the subject property on or before 19.08.2026 and also, pay use and occupation charges @ Rs. 2,500/- from 19.02.2026 to 18.08.2026.
4. Let an affidavit of undertaking be placed on record before the next date of hearing.
5. List on 21.04.2026."

On 21.04.2026, none appeared on behalf of the petitioner and accordingly, court notice was issued to the petitioner. 5.
In pursuance of the court notice issued, learned counsel for the petitioner enters appearance and submits that the possession of the subject property has been handed over and further seeks leave to withdraw the present petition.
