By way of present petition, the petitioner seeks quashing of FIR bearing no. 256/2025, registered at Police Station Sector-23, Dwarka, for the commission of offence punishable under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023 (hereafter 'BNS').

The petitioner and respondent no. 2 are present before this Court and have been identified by their counsels and concerned Investigating Officer The authenticity of the order can be re-verified from Delhi High Court Order Portal by scanning the QR code shown above.

Briefly stated, facts of the present case are that in March, 2024, the petitioner and respondent no. 2 engaged in discussions, and respondent no. 2 expressed their intention to buy an immovable property at Sector-23, Dwarka, New Delhi. Further, it is stated that the petitioner and his wife are the co-owners of the aforesaid property. However, discussions could not be completed between the parties and the parties had thereafter engaged in further discussions in 2025, pursuant to which certain payments were made by respondent no. 2 to the petitioner. It is stated that on 29.03.2025, respondent no. 2 had transferred an amount of Rs. 1,60,00,000/- and on 07.08.2025, she had further transferred an amount of ₹1,27,10,000/- to the petitioner. Based on the aforesaid events, the present FIR was registered on 09.10.2025 against the petitioner under the relevant sections. It is stated that both the parties have amicably settled the present matter vide Settlement Agreement dated 08.01.2026.

On a query made by this Court, respondent no.2 who has been identified by the concerned IO, has categorically stated that she has entered into compromise out of her own free will and without any pressure, coercion or threat. It is also stated by respondent no. 2 that the entire dispute has been amicably settled between the parties. Respondent no. 2 further states that she has no objection if the present FIR is quashed. 7.

The learned APP for the State, on instructions from the concerned Investigating Officer, submits that the present case is not a multi-victim case and is a private dispute between the petitioner and respondent no. 2. He also states that there is no previous involvement of the petitioner in any criminal case.

In view of the above fact that the parties have amicably resolved their differences out of their own free will, without any coercion, no useful purpose will be served by continuing the proceedings, rather the same would create further acrimony between them. It would thus be in interest of justice to quash the abovementioned FIR and the proceedings pursuant thereto. There is no legal impediment in quashing the FIR in question. 9.

Accordingly, FIR bearing No. 256/2025, registered at Police Station Sector-23, Dwarka, for the commission of offence punishable under Section 318(4) of the BNS and all consequential proceedings emanating therefrom are quashed.

In view of the above, the present petition stands disposed of. Pending application also stands disposed of.
