Learned counsel for the appellant/AIIMS states that aggrieved by the order dated 08.11.2019, passed by this Court rejecting the stay application filed with the appeal (CM APPL. 48137/2019), for seeking stay of the impugned judgment dated 14.10.2019, passed by the learned Single Judge in W.P.(C) 9480/2019, the appellant/AIIMS had filed an appeal before the Supreme Court, registered as SLP(Civil) Diary No.40610/2019, which was dismissed vide order dated 25.11.2019, with an observation that there was no ground to interfere with the said order. A copy of the order dated 25.11.2019 is handed over by learned counsel for the appellant/AIIMS and is taken on record.

Learned counsel states that after the order dated 25.11.2019 came to be passed, upholding the orders passed by this Court on 08.11.2019, the appellant/AIIMS had issued a letter of joining to the respondent in the end of November, 2019 itself.

As for the merits of the judgment impugned in the present appeal, learned counsel for the appellant/AIIMS states on instructions that w.e.f. the academic year 2020-21 that shall commence in the month of July, entrance to the MBBS course shall not be conducted by AIIMS, but a National Examination Eligibility Test (NEET) shall be conducted in pursuance to the National Medical Council Act, 2019.

He thus states that in view of the changed circumstance, the present appeal has been rendered infructuous and the appellant/AIIMS does not wish to press the same any further. 4.

While recording the statement made by learned counsel for the appellant/AIIMS as above, the present appeal is disposed of as not pressed alongwith the pending application.
