% 11.02.2020 A pass over is sought on behalf of the petitioner inter alia seeking the presence of the respondent no.2. So far, no notice of the petition has been ordered to the respondent no.2. The petitioner vide the present petition seeks the quashing of the FIR No.598/2015, PS Rajouri Garden registered under Section 354 of the Indian Penal Code, 1860 and Section 8 of the POCSO Act, 2012 submitting to the effect that a settlement has been arrived at between the petitioner and the father of the respondent no.2, the respondent no.2 being a minor child aged 14 years at the time of the occurrence.

On a bare perusal of the averments made in the FIR and the statement under Section 164 of the Cr.P.C., 1973 of the prosecutrix recorded on 06.05.2015 which brings forth gross allegations of mental depravity against the petitioner, there is no ground for quashing of the present FIR.

The petition is thus, declined.

Nothing stated hereinabove shall however amount to an expression on the merits or demerits of the trial before the learned Trial Court.
