The present writ petition has been filed seeking a direction to the respondents no.3 and 4 to stop the illegal and unauthorized construction at properties bearing No.530, 531 and 532, Gali No.10, Manglapuri, Phase-1, Palam Colony, New Delhi-110045 (hereinafter the 'subject properties'). It is also stated that the respondent no.4/builder has illegally constructed iron gates to block entry into the colony of the subject properties.

Ms. Shilpa Dewan, counsel appearing on behalf of the respondent no.2/MCD, submits that the respondent no.2/MCD has booked the subject properties as well as the property of the petitioner and shall take appropriate action in accordance with law.

Insofar as the iron gates which have been constructed in the colony are concerned, Mr. Sunil Dalal, Senior Counsel appearing on behalf of the respondent no.4 submits that the said iron gates as well as the guard room (page 54 of the writ petition) have not been constructed by the respondent no.4 and that the same were constructed by the RWA. 5.

The respondent no.2/MCD shall verify the position and take appropriate action in accordance with law.

The respondent no. 2/MCD shall ensure that no construction is carried out in the subject properties till the respondent no. 2/MCD takes a decision on the show cause notice issued to the respondents no.3 and 4. 7.

The writ petition stands disposed of in the aforesaid terms.
