% 08.05.2018 A Status Report has been filed. As per the Status Report, mother of the petitioner aged 50 years, was found residing at B-369A, Lal Kuan, BBlock, New Delhi. Father of the petitioner has since passed away. As per the Nominal Roll the petitioner has been granted regular parole and furlough even in the year 2017 when he was granted once parole and once furlough. The impugned order passed by the competent authority rejecting parole was primarily for the reason that the petitioner was awarded jail punishment on 10th April, 2017 for the reason he was found in possession of tobacco. Since more than one year has elapsed from the last jail punishment and in view of the previous conduct of the petitioner whereby as and when he was released on parole and furlough he surrendered in time, this Court deems it fit to grant parole to the petitioner. W.P.(CRL) 45/2018
It is, therefore, directed that the petitioner be released on parole for a period of four weeks from the date of his release on his furnishing a personal bond in the sum of ₹10,000/- with one surety of the like amount, subject to the satisfaction of the Superintendent, Tihar Jail. Petition is disposed of.
A copy of this order be communicated to the petitioner through Superintendent, Tihar Jail.
