Learned counsel for the respondents states that all the arguments put forth before this court are available to the petitioner to argue before the concerned session court at the time of framing of charge. 2.

I am in agreement with the same. This court has not adjudicated upon the merits of the contentions raised in the present petition, the petitioner is at liberty and will argue all the issues raised in the present petition before the concerned Session Court and the same will be adjudicate on its merits. Needless to add that all legal rights of the petitioner are open. 3.

Granting the said liberty, the petition is disposed of. 4.
